Terms of Service for MyApp Studio

These Terms of Service ("Terms") govern your access to and use of MyApp Studio, a product of Clearbrook Software LLC ("the App," "we," "us," or "our"), including our Android and iOS applications, backend services, and related websites. By signing in and using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

MyApp Studio is an AI-powered app builder. You describe an application you want by voice or text, and the App utilizes Google's Gemini models to generate a structured application schema and custom views. This generated mini-application ("a MyApp") runs inside MyApp Studio's runtime preview environment and can optionally be installed on your device as a standalone Progressive Web App (PWA) or pinned to your home screen.

2. Eligibility and Authentication

• Sign-In: To use the App, you must authenticate using Google Sign-In or, on iOS, Sign in with Apple (both via Firebase Authentication). We do not support other login methods and never receive your Google or Apple account password.
• Account Responsibility: You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. AI-Generated Code and Disclaimers

• As-Is Generation: MyApps, including custom HTML, CSS, and JavaScript, are generated dynamically by artificial intelligence. We do not review, verify, or guarantee the correctness, accuracy, functionality, safety, or security of any AI-generated code.
• Client-Side Execution: Generated code executes client-side within an embedded web view on your device. You acknowledge that AI-generated code may contain bugs, security vulnerabilities, or unintended behaviors.
• Risk of Use: You assume all risk and liability arising from running, installing, or sharing AI-generated MyApps.
• AI Actions (runtime AI/search lookups): Some MyApps, if you approve them when the MyApp is built or edited, include an "AI Action" feature that looks up data from AI — and, for certain lookups, from web search — while you are using the app (e.g., auto-filling nutrition facts for a food you typed). Each use sends the value you entered into that lookup to our AI provider (and, for search-backed lookups, to a search provider) and consumes AI credits from your token balance, as described in Section 7. We do not review, verify, or guarantee the accuracy, currency, or completeness of any AI Action result, and you should not rely on it for decisions where inaccurate information could cause harm (e.g., medical, financial, or safety-related decisions). 4. User-Generated Content (UGC) and Conduct

MyApp Studio allows you to create customized MyApps, input data into them, and share them with other users. All MyApps, table structures, and data rows created or shared by you are considered "User Content."

You represent and warrant that your User Content and your conduct will not violate any applicable laws or these Terms. Specifically, you agree not to create, upload, store, or share any User Content that:

• Is defamatory, harassing, abusive, threatening, or promotes hate speech or violence.
• Contains sexually explicit, obscene, or pornographic material.
• Promotes illegal activities or provides instructions on how to conduct illegal acts.
• Infringes the intellectual property rights, privacy rights, or publicity rights of any third party.
• Contains malware, viruses, harmful scripts, or exploits designed to compromise device security.
• Is deceptive, fraudulent, or impersonates any person or entity.

5. Content Moderation: Flagging and Blocking

To ensure a safe environment and comply with Google Play and Apple App Store policies, we employ a strict content moderation policy for User Content:

• Flagging for Review: Any user can flag any MyApp in their library for review using the "Flag for Review" menu option. Flagging writes a report to our administrators and triggers a manual review. We commit to reviewing flagged content and taking appropriate action within twenty-four (24) hours of submission.
• Blocking Users: You can block any user within the App's Sharing Settings or when declining a shared app. Blocking a sender immediately deletes all MyApps they have shared with you from your library.
• Automated Cascade Removal: If you flag a MyApp shared by another user, the App will automatically block that sender and remove all of their other shared MyApps from your library to protect you from further unwanted content.
• Automated Content Filtering: The App utilizes automated AI safety filters to detect and block objectionable or harmful content (such as hate speech, harassment, sexually explicit material, or dangerous instructions). These filters apply to chat and voice assistant sessions and to every AI call that builds or edits a MyApp, and an automated review step additionally checks a generated MyApp's content before it is saved. These are automated controls applied at generation time; they do not review content you type into your MyApps yourself afterward, which is covered by the flagging and blocking controls above.
• Enforcement Actions: We reserve the right, in our sole discretion and without prior notice, to remove objectionable User Content, suspend or terminate user accounts, and block access to the service for users who violate these Terms.

6. Personal Data and Encryption

• On-Device Encryption: MyApp Studio automatically classifies certain tables as personal (e.g., journals, mood logs, or history tables) and encrypts their row data on your device (using AES-256-GCM) before syncing to our servers.
• Key Ownership and Loss: Encryption keys are stored locally on your device (secured by your device's operating-system credential storage — the Android Keystore system on Android, the Keychain on iOS). You can optionally set a passphrase to sync these keys across your devices. We never receive or store your passphrase. If you lose your passphrase or device encryption key, your personal data is permanently unrecoverable by us or by you.
• Default Sharing Exclusion: By default, personal tables are excluded (rows are stripped) when sharing MyApps. If you choose the "Advanced" override to share personal table data, that data will be shared in an unencrypted state with the recipient.

7. App Slots and AI Usage Limits

• Free Allotment: Each account receives a starting allotment of app creations ("app slots") and a daily allowance of AI-powered features at no cost. These amounts are set by us and may change at any time, including for existing accounts.
• No Purchases Currently Available: We do not currently process any payments. The App contains no purchase flow and collects no payment information.
• No Guarantee of Continued Free Access: We reserve the right to introduce paid pricing, change allotments or usage limits, or limit free usage at any time, with or without notice. Continued use of the App after such a change constitutes acceptance of the new terms for future usage.
• No Entitlement: App slots and AI usage allowances have no cash value, are not transferable, are not redeemable for cash, and may be forfeited if your account is deleted, suspended, or terminated.
• Abuse Prevention: To prevent a deleted-and-recreated account from repeatedly claiming a fresh free allotment, we retain a durable record tied to your account's email address or phone number (independent of your Firebase Authentication record) tracking how much of the free allotment that identity has used. This record survives account deletion; see Section 10.

8. Intellectual Property

• Our Materials: We own all rights, title, and interest in MyApp Studio, the backend infrastructure, the runtime environment, CSS style systems, and the application's source code.
• Your Apps: You retain ownership of the specific schemas, structural specifications, and data rows you create. By generating and hosting these apps with us, you grant us a worldwide, non-exclusive, royalty-free license to host, store, replicate, transmit, and process your User Content solely for the purpose of providing and improving the service.

9. Limitation of Liability and Indemnification

• No Warranty: The App and services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied.
• Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, data, use, goodwill, or other intangible losses, resulting from:

- Your use or inability to use the App.

- Any code or behavior of AI-generated MyApps.

- Unauthorized access to or alteration of your content.

- The behavior or content of other users (including shared MyApps).

• Indemnification: You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of your violation of these Terms or your infringement of any third-party rights.

10. Account Deletion and Termination

• User-Initiated Deletion: You can delete your account and all associated data at any time via the Delete Account option in the App's account menu, or by submitting our public Account Deletion Request Form. Deletion permanently erases your Firebase Authentication record, MyApps, sharing data, and log data. As described in Section 7, one narrow exception applies: a record of how much of the free app-slot allotment your email address or phone number has used is retained (not tied to your deleted Firebase Authentication record) so the same free allotment cannot be claimed again by simply recreating an account with the same contact identity.
• Termination by Us: We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

11. Marketing Communications

• Email Updates: Our marketing website lets you provide your email address to be notified about MyApp Studio's availability and related product updates. Providing this email does not create an App account and is not required to use the App.
• Opting Out: You may stop receiving these updates at any time by contacting us through our Contact Us form; we do not currently offer a self-service unsubscribe link.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions.
